Safety Policy
Last updated: September 10, 2026
PullUp Rideshare uses safety policies, screening, trip records, verification tools, reporting channels, and program requirements to reduce risk. No transportation platform can eliminate all risk. This Safety Policy applies to riders, drivers, account holders, enterprise users, partners, contractors, volunteers, and anyone participating in a PullUp service.
1. Emergencies
PullUp is not an emergency-response service. If there is an immediate threat to life, serious injury, fire, crime in progress, or another emergency, call 911 or the appropriate local emergency service first. PullUp support may assist with platform records or follow-up but is not a substitute for emergency responders.
2. Driver Safety Duties
Drivers must comply with traffic laws, remain properly licensed and insured, operate a roadworthy vehicle, avoid impaired or distracted driving, follow safe pickup and drop-off practices, and decline or stop a trip when continuing would be unlawful or present an immediate safety threat.
3. Rider Safety Duties
Riders must provide accurate pickup and destination information, confirm the correct vehicle and driver, use seat belts and lawful child restraints where required, avoid distracting or interfering with the driver, and refrain from violence, threats, harassment, property damage, illegal activity, or conduct that creates an unreasonable safety risk.
4. Verification and Trip Records
PullUp may use PIN verification, GPS, timestamps, device information, communications, photographs, delivery proof, rider or driver confirmations, ratings, or other records to support trip integrity and safety. These tools are risk-reduction measures and are not guarantees that every person, vehicle, location, or trip is safe.
5. Screening and Eligibility
PullUp may require identity checks, driving-record reviews, background screening, insurance verification, vehicle documentation, training, or additional program qualifications. Screening is based on information reasonably available at the time and does not guarantee future conduct, the completeness of third-party data, or the absence of risk.
6. Unsafe or Prohibited Conduct
Violence, sexual misconduct, stalking, intimidation, retaliation, intentional endangerment, fraud, trafficking, unlawful weapons use, criminal activity, and deliberate interference with vehicle operation are prohibited. PullUp may immediately suspend access where credible information indicates a serious safety risk.
7. Drugs, Alcohol, and Impairment
Drivers must never operate a vehicle while impaired by alcohol, illegal drugs, misused medication, fatigue, or another condition that makes driving unsafe or unlawful. Riders may not create an unsafe environment through intoxication, threats, or conduct that substantially interferes with safe operation.
8. Incident Reporting and Evidence Preservation
Users should promptly report serious incidents and preserve relevant messages, photographs, trip records, police report numbers, medical documentation, insurance information, or other evidence. PullUp may preserve platform data and cooperate with law enforcement, insurers, attorneys, regulators, enterprise clients, or other authorized parties when lawful and reasonably necessary.
9. No Guarantee of Continuous Monitoring
PullUp may monitor certain platform signals or respond to reports, but unless applicable law expressly requires otherwise, PullUp does not undertake a duty to continuously monitor every vehicle, person, message, route, location, or trip in real time. A safety feature’s availability does not create a guarantee that an incident will be detected, prevented, or resolved.
10. Third-Party Conduct
Riders and drivers are responsible for their own conduct. To the fullest extent permitted by law, PullUp and the Protected Parties are not liable merely because an independent third party commits criminal, reckless, fraudulent, or intentional misconduct that PullUp did not cause and for which applicable law does not impose responsibility on PullUp.
11. Protected Parties and No Personal Liability
For this policy, “Protected Parties” means Onyx Repository Foundation, PullUp Rideshare, and their current and former directors, officers, founders, employees, volunteers, contractors, agents, representatives, successors, and assigns, including Rodney Addison and Amanda Dixon when acting in connection with PullUp, Onyx Repository Foundation, or an authorized program.
To the fullest extent permitted by law, no Protected Party incurs personal liability merely because that person designed or communicated a safety policy, reviewed a complaint, participated in screening or eligibility decisions, administered a safety program, responded to an incident, or made a good-faith decision within the scope of organizational duties.
This protection does not limit liability that applicable law does not permit to be limited, including for a person’s own fraud, willful misconduct, gross negligence where non-waivable, or other conduct for which liability cannot lawfully be disclaimed.
12. Assumption of Ordinary Transportation Risk
By using PullUp, riders and drivers acknowledge ordinary risks associated with road travel, weather, traffic, vehicle movement, pickup and drop-off environments, and interactions with other people. To the fullest extent permitted by law, users assume those ordinary inherent risks while retaining all rights and remedies that applicable law makes non-waivable.
13. Indemnification for User Misconduct
To the fullest extent permitted by law, a user agrees to defend, indemnify, and hold harmless PullUp and the Protected Parties from third-party claims arising from that user’s unlawful acts, unsafe conduct, intentional misconduct, fraud, policy violations, or violation of another person’s rights. This does not require indemnification for liability that law places solely on a Protected Party and does not permit to be shifted.
14. Safety Actions and Account Restrictions
PullUp may temporarily restrict, suspend, deactivate, or condition access when reasonably necessary to investigate a serious safety concern, protect users, comply with law, preserve evidence, or reduce an identified risk. These actions may be taken before a final factual determination when immediate risk management reasonably requires it.
15. Relationship to Other Policies
This Safety Policy supplements the PullUp Terms of Service, Rider Terms, Driver Terms, Community Guidelines, and service-specific policies. If applicable law imposes a higher safety obligation, that law controls.
