Non-Discrimination Policy
Last updated: September 10, 2026
PullUp Rideshare is committed to providing access to services without unlawful discrimination. This policy applies to riders, drivers, account holders, enterprise users, partners, contractors, volunteers, and anyone participating in a PullUp program.
1. Prohibited Discrimination
PullUp prohibits discrimination, harassment, denial of service, unequal treatment, retaliation, or adverse action based on any characteristic protected by applicable federal, state, or local law. Protected characteristics may include, depending on jurisdiction, race, color, national origin, ancestry, religion, sex, pregnancy, sexual orientation, gender identity or expression, disability, age, marital or familial status, veteran status, genetic information, and other legally protected classifications.
2. Driver and Rider Obligations
Drivers may not refuse, cancel, delay, reroute, provide inferior service, or otherwise treat a rider differently because of a protected characteristic. Riders may not discriminate against, harass, or demand replacement of a driver for a prohibited discriminatory reason.
Preferences, ratings, Favorite Driver tools, PullUp Circle relationships, enterprise settings, or other platform features may not be used to bypass anti-discrimination requirements.
3. Legitimate Safety and Eligibility Decisions
This policy does not prevent a lawful, documented decision based on a legitimate safety concern, legal requirement, service-area limitation, vehicle capacity, program eligibility rule, payment issue, rider or driver conduct, unavailable equipment, or other non-discriminatory operational reason. A lawful safety-based decision must not be a pretext for discrimination.
4. Accessibility and Service Animals
Disability-related requests and lawful service animals are governed by the Accessibility & Service Animal Policy and applicable law. Personal preferences do not override legal accessibility obligations.
5. Reporting
Users should report suspected discrimination through available PullUp support channels and provide relevant trip details or evidence where available. PullUp may review platform records, communications, complaints, prior incidents, or other lawful evidence.
6. Enforcement
PullUp may educate, warn, restrict, suspend, deactivate, remove program eligibility, or take other appropriate action against a person who violates this policy. Serious or repeated discrimination may result in permanent loss of platform access. PullUp may cooperate with regulators or law enforcement when legally required or reasonably appropriate.
7. Good-Faith Decision Making
PullUp may make good-faith eligibility, safety, complaint, and enforcement decisions based on the information reasonably available at the time. The fact that a complaint is unsubstantiated, disputed, or later resolved differently does not by itself establish bad faith, discrimination, or personal wrongdoing by a representative who acted reasonably and within organizational authority.
8. Protected Parties and No Personal Liability
For this policy, “Protected Parties” means Onyx Repository Foundation, PullUp Rideshare, and their current and former directors, officers, founders, employees, volunteers, contractors, agents, representatives, successors, and assigns, including Rodney Addison and Amanda Dixon when acting in connection with PullUp, Onyx Repository Foundation, or an authorized program.
To the fullest extent permitted by law, no Protected Party incurs personal liability merely because that person received or investigated a discrimination complaint, communicated a policy, enforced platform standards, made a good-faith eligibility or safety decision, or otherwise acted within the scope of authorized organizational duties.
This protection does not limit liability that applicable law does not permit to be limited, including for a person’s own unlawful discrimination, fraud, willful misconduct, or other non-waivable conduct.
9. No Expansion or Waiver of Statutory Rights
This policy is intended to support compliance with applicable law. It does not narrow any statutory right, create a waiver of a non-waivable remedy, or create a contractual cause of action beyond rights otherwise provided by law or an applicable written agreement.
10. Indemnification for Discriminatory Misconduct
To the fullest extent permitted by law, a user whose discriminatory or retaliatory misconduct causes a third-party claim agrees to defend, indemnify, and hold harmless PullUp and the Protected Parties from losses arising from that user’s conduct, except to the extent a loss is legally attributable to a Protected Party’s own non-transferable wrongdoing.
11. Relationship to Other Terms
This policy supplements the PullUp Terms of Service, Driver Terms, Rider Terms, Community Guidelines, and Accessibility & Service Animal Policy. If applicable law provides greater protection, the law controls.
